DURHAM 鈥?Ontarios top court has upheld the conviction of an Oshawa man who is serving life in prison for the 2009 murder of his domestic partner.In a ruling released Nov. 12, the Ontario Court of Appeal rejected Ken Mullins argument that a judge committed errors that rendered his 2011 murder trial unfair. Mullin was convicted of second-degree murder in the death of his partner Sherry Martin; he was sentenced to life, with parole eligibility set at 12 years.Mullin argued on appeal that Superior Court Justice Cary Boswell erred by allowing jurors to hear a tape of a frantic 911 call made by a friend of Martins on the night of the killing. Other grounds of appeal focused on the judges instructions to jurors, and allowing evidence of a previous incident in which Mullin had been convicted for threatening Martin.
